Edwin Castro's lawyer, David De Paoli, claims to have viewed clear CCTV footage showing Castro purchasing the winning $2.04 billion Powerball ticket.
Jose Rivera, who alleges he bought the ticket and it was stolen from him, has been charged with filing a false police report.
The California State Lottery Commission has not publicly released the CCTV footage but maintains that Castro is the rightful winner.
Rivera's lawsuit against Castro, the lottery commission and his former landlord, Urachi Romero, is ongoing.
Since claiming his winnings, Castro has purchased three massive mansions in California worth tens of millions of dollars.
