Moderna Wins Patent Case Against BioNTech and Pfizer Over mRNA Technology

A German court has ruled in favor of Moderna, ordering BioNTech and Pfizer to disclose profits and pay damages for patent infringement.

The Düsseldorf Regional Court ruled that BioNTech and Pfizer infringed on Moderna's patents related to mRNA technology used in COVID-19 vaccines.
Moderna alleged that the companies copied its patented technology developed between 2010 and 2016 without authorization.
BioNTech and Pfizer argued that Moderna had permitted use of the patents until May 2023, citing a 2020 press release, but the court found this permission was revoked in March 2022.
The ruling orders BioNTech and Pfizer to provide details on the extent of patent use, profits made, and to pay damages and compensation to Moderna.
The decision is not final, and any appeals would be handled by the Higher Regional Court of Düsseldorf.
